This self executing contract and agreement of "Terms of Usage of Works" is a legal binding contract between the man who goes by the name Brian T Collins known as "composer" "artist" "coach" "author" "I" "my" "me" "his" "owner" "copyright holder" "Grantor" "Licensor" now governing any and all other man or men or woman or women or child or children or individual or group or school or institution or agency or corporation or person or artificial intelligence or machine or entity now known as "you" "your" "user" "individual" "person" "anyone" "client" "clients" "any-other" "third party" "parties" "publisher" "journalist" "media broadcaster" "Grantee" "Licensee" in regards to the usage of all creations and energy input/output of Brian T Collins known as "music" "art" "writing" "work" "works" "creative expression" "media" "coaching" "service" "creative works" "audio/visual" "content" "copyrighted" "copyright" "intellectual property."
This serves as public and private notice to how you, an individual, person or man or woman or any-other or entity may use the music or works of Brian T Collins through usage.
"Usage" means certain rights granted by the artist to you for use of the artists works.
"Reasonable enjoyment" means you have a limited right to listen or view the creative works of Brian T Collins so you can enjoy, relax or meditate for recreational purposes only. However reasonable enjoyment does not mean a transfer of rights to use the artists works for any third party media or event or commercial venture or personal or group occult practices in private or public or to use the artists works under any acts of actual or perceived association or acts of immoral turpitude. For more on these clauses see the definitions below in Expressed Notice of Non-Consent of Usage.
"non-consent" means you do not have expressed or implied rights of usage in any form or medium.
"core values" means foundational beliefs and actions that support positive and moral ethics that maintains the integrity of Brian T Collins.
"life force" is a non-negotiable medium of living energy that you, or any-other or entity has no rights to harvest, interfere, manipulate or extract.
"soul permission" means the ultimate life force rights granted by the prime creator that governs all life and the destiny or creative energy and living force of the artists and his rights to pursue a life free of restriction and censorship of his life or his creativity or his works and his rights to procure abundance or health and pursuit of happiness. Soul permission is considered a universal prime directive that must not be trespassed by you or any-other or entity throughout the universes and world territories in perpetuity. To trespass against the soul permission of the artist is a grievous universal crime against the life force of the artist and the creator of life force itself.
Please keep in mind that ALL of the artists works, music recordings and performances and any and all copyrighted content included but not limited to writing or audio/visual works or any intellectual property of the voice and content shared in any communication or interview or transcriptions or realized real time content transmitted from the artist remain the sole property of the man who goes by the name Brian T Collins whose likeness is displayed herein. All works intellectual property and expressions of creativity are copyright ©Brian T Collins All Rights Reserved.
The artist will from time to time make certain works available in the public for marketing and promotional purposes and that such public displays of the work does not constitute a transfer of any rights to any third party or any-other.
This means you do not have a legal or moral or energetic right to use or transmit any of the works or intellectual property of the artist and Licensee known as Brian T Collins without obtaining a license.
Obtaining Rights of Usage
Upon purchase of any works of the artist and Licensor you are hereby granted a non-exclusive limited license of limited rights of usage for the reasonable enjoyment of the works.
Upon purchase, your limited license grants you (the Grantee and Licensor) a limited right to enjoy the works of Brian T Collins but you may NOT use his works by any other third party means or in any commercial venture or in any event transmission private or public unless a separate license is purchased. There are several types of license for usage defined below.
In regards to all publishing and displays of the works, Brian T Collins reserves the right to review all usage where his works will be published or displayed or transmitted publicly or privately and has final say to the finished outcome of where his works are displayed under usage.
If the criteria for the artists core values are not met or misrepresented contrary to the artists best interest, the artist reserves the right to null and void any prior contract granting a license to rights of usage and cancel the legal right to use his works. The artist will refund the amount of the license less any administration fees charged by third parties, however the amount to commission the works are non-refundable. If a user or Licensee refuses to disclose the legal information of any third party that enjoins the works, the artist has the right to sue the Licensor for punitive damages and breach of contract.
You may not under any circumstances directly or indirectly by proxy engage in dishonorable actions such as alter, steal, plagiarize, take, extract, copy or use in public or private or enjoin any of the artists works to any other unauthorized third party works. To do so means you are breaking the law as a criminal and you are fully liable for punitive damages.
If you do not purchase the works of Brian T Collins then you have NO rights at all to any usage of the works or to use name of the artist in any other publishing or in physical or electronic print or display throughout the universe and worldwide territories including without limitation the world wide web ab initio. (from the beginning)
Using the artists works or name without purchase and grant of license and written expressed permission by the artist means you are engaging in a willful criminal act and are liable for punitive damages.
That also includes without limitation publishing the works of the artist or making copies of the works or distributing the works or altering the artists copyright content or hacking and altering any prior content published by the artist or enjoining the artists name in any third party publication or book or on any other world wide web page or portal hosted by internet service provider. (ISP)
If you publish any content or works or name of the artist without the expressed written and verbal authorized consent of Brian T Collins you are engaging in an international and federal criminal act and past statutes of limitation you are liable to compensate the artist for punitive damages from the date of the unauthorized publishing to the future until you remedy the artist.
The artist expressly forbids the clause of 'fair usage' under journalism as a reasonable third party excuse at law to publish any content or works or name of Brian T Collins or Brian T. Collins without expressed written consent from the artist Brian T Collins.
If you breach this self executing contract then your actions are against international law and the artist reserves the right to legal proceedings to sue you for punitive damages and compensation for the illegal usage of his works and artist name Brian T Collins.
If you would like to commission my works for commercial usage, events or , you must purchase a separate license.
There are several tpyes of licenses available and each has different terms of usage. Please read all terms carefully as this is a legal binding contract.
All licenses are non-exclusive, meaning you are not the exclusive user of the works and the artist can license out the same works to many users or clients.
How you may use a license
Most licenses are granted under a yearly subscription price, meaning you purchase a license to usage of the works on a per annum basis, for as long as the subscription is paid you are granted a right to usage. The fee covers the usage for one years and is non-refundable.
Ending a subscription license
If you wish to end a subscription you must give the artist written notice no less than two weeks before the due date of the subscription. Upon end of license of usage you must terminate the usage of the works immediately which ends your right to usage of the works.
Upon termination the user or client is legally bound by law to purge the artists works from all associated media and databases both of the user and client or any-other third party who accessed the works of the artist. Proof must be given by end of contract in writing and must includes the legal names and correct contact information of all parties that obtained usage of the artists works directly or indirectly by proxy.
Consequences of breaching the usage
Failure to comply to the terms and termination of usage by obfuscation or continuing to use the works of the artist after a license has expired or has been canceled by the artist under his non-consent is considered constructive fraud and you and any-other will be held liable for criminal charges and punitive damages.
Flat fee rather than subscription
There is also a buyout license for each giving you a non-exclusive right to use the license for a determined amount of time by the artist. This can save you money in the long run, if you plan to use the artists works for a longer
predetermined time period.
If you require an exclusive license on any works you must meet certain requirements of the artist.
There are several types of license available for purchase.
Synchronization License (Sync License)
This type of licensing means music, recordings or any works that will be paired with another form of third party visual media works. A sync license has a broad range of uses, including without limitation, commercials, films, trailers, video usage, streaming on social media platforms. personal films, internal communications and more. There are some restrictions about the usage of the works used in private. Please read the section about perceived association, moral turpitude and private and public usage for more details.
Mechanical License
A mechanical license means any third party usage of distributing the artists works by means of tangible forms such as CD's DVD's usage via broadcasting such as record labels, publishers or distributers. A mechanical license is needed by any third party who covers any works of the artist in whole or part. that includes without limitation adding own lyrics, re-mixing, or altering any part of the original recordings or works that may affect the artists works or compositions or integrity either directly or indirectly.
Master license
The master license is held by the owner the composition or recordings or works, namely Brian T Collins. The artist is also the master publisher. The master license grants a limited user a specific right to use a pre-recorded version of a song or composition or creative works in a visual or audio project. (i.e. to cover or edit a composition) but it does not transfer any rights of Brian T Collins as the master holder and publisher to the user. A master license is the foundation license issued in conjunction with a sync license.
Public Performance License
This license grants a limited right to the user to transmit the artists music or works in any live events or business that may play the artists musical works in their business (i.e. store, public address system or any other forms of live transmission in a public venue) Performing rights organizations such as TUNECORE®, SOCAN®, BMI®, ASCAP® manage and issue music royalties to the artist on a per use basis.
Print Rights License
This license grants a limited right for a user or publisher to reproduce the artists works by printing a sheet music copy or compilation of the artists copyrighted works or by printing any of the artists content or intellectual property or artists name for consideration in any electronic or tangible book or publication. The artist reserves the right to review any publishers works prior publication release date to maintain the artists core values for accuracy of factual information. It does not grant a commercial interest in any of the artists rights and any user or person or publisher who publishes the artists works or name in any publications must pay a royalty to the artist for any print of his works and name from the beginning date of the publication to the future in perpetuity.
Theatrical License
This License grants a user a limited right to perform the artists works on-stage in front of an audience.
SPECIFIC EXPRESSED NOTICE OF NON-CONSENT TO USAGE
Please read carefully to actions and practices I do not allow under usage of my works. Unfortunately a few rotten apples spoil the collective, so I must give notice to certain things I will not tolerate or accept under any circumstances. Namely, actions by those who deceive or are dishonest or misrepresent my reputation regarding the usage of my works and creative expression and trade-name... This is a legal binding contract and can affect you or any-other and your usage of the works.
The artist known as Brian T Collins does not grant Soul Permission and does not consent to the following usage of his name, his compositions, his musical recordings, his brands, his graphics, his content, his visuals, his likenesses his websites or any form of his works being used in any form of communication written or verbal or license or joint venture or coaching client or any third party relationship under the following:
Manufactured Consent
This refers to gaining the trust and consent of the artist by means of deceit or hidden agenda or obfuscation or tacit/silent consent for means of any other act other than what is expressed fully in writing under full honest integrity and transparency. The act of gaining trust and manufactured consent to deceive the artist to transfer any intellectual property or energetic expression of creativity or life force is immoral, is a criminal act and a trespass which null and voids all rights of the user or Licensee to the usage of the artists works permanently.
If the user or Licensee has been noticed by the artist to remove his works from all transmissions worldwide and his intellectual property is taken and altered. The artist has the right to sue any user or Licensee for punitive damages as trespass for unethical violation.
Unauthorized Publications of Works and Name
This refers to publishing or transmitting any broadcast or altering or theft or plagiarizing any of the artists works or intellectual property or name or content under the intent to commit personal gain, monetary gain, subscriber acquisition, fame or notoriety or market advantage or leverage by harming or damaging the of reputation causing any loss to the artist known as Brian T Collins.
Acts of Actual or Perceived Association
This refers to enjoining the artists works or name to any other third party or third party works that may directly or indirectly damage the reputation or business or personal life of the artist via the publics perceived association to what ever third party content may be transmitted by any means. Perceived association includes without limitation all the terms of non-consent listed herein. The artist does not consent or give soul permission for his works and intellectual property to be used in any actual or perceived association. The artist has the right to sue any user or Licensee for punitive damages as trespass for this violation..
Acts of Immoral Turpitude
This refers to enjoining the artists works or name to any other third party or third party actions or works or actual or perceived association that display acts of immoral turpitude that may directly or indirectly damage harm or damage the reputation or business or personal life or international trade of the artist via the publics actual or perceived association to whatever third party content may be transmitted by any means. Acts of immoral turpitude includes without limitation any usage or performance in any cults or hidden occult rituals or practices for the purposes of energy harvesting or life force harvesting or mind entrainment or enjoining to any form of actual or perceived association to symbolism or geometry or spells or incantations or witchcraft or wicca or curses or practices and rituals of pagan or illuminati or freemasonry or occult mystery schools or fraternities or gnostic/luciferian illuminated or religious practices or mind control or predictive programming or torture or subconscious programming or any act for the purposes of harvesting of life force energy of the artist or harvesting of the life force of any-other or for acts of sacrifice of homo sapiens or animals or ritualistic abuse or harming or human trafficking of men women or children or for use in prostitution or blackmail or extortion or in usage of any pornography or deep fake videos or for the purposes of gaining any personal or group esoteric power or leverage over the artist or any other man woman child or person. The artist does not consent or give soul permission for his works and intellectual property to be used in any acts of immoral turpitude. The artist has the right to sue any user or Licensee for punitive damages as trespass for this violation.
Occult Rituals or Practices
This refers to using the artists works being used in any individual or group usage private or public to any occulted rituals or practices or cult actions. The artist does not consent to his works being used by anyone in any type of occult or magic or esoteric act. Although the artist licenses general usage for meditation covered under reasonable enjoyment, the artist does not consent or give soul permission for his works and intellectual property to be used in any cults, occult rituals or magical practices. The artist has the right to sue any user or Licensee for punitive damages as trespass for this violation.
Energy /life force harvesting
This refers to the highest form of breach of soul permission and any and all parties who engage in this type of act by gaining manufactured consent through deceit, obfuscation or occulted means is engaging in a repugnant act and direct violation of soul permission under the prime laws of life force creation. Such acts carry immediate blowback by the prime creator of life force and the artist does not consent or give soul permission for his works and intellectual property to be used in any energy/life force harvesting. The artist has the right to sue any user or Licensee for punitive damages as trespass for this violation.
This self executing end user contract and agreement of terms of usage is legally binding and is subject to change at the discretion of the artist Brian T Collins and the artist reserves the right to arbitration in a venue of his peers or his legal choosing. Punitive damages for breach of contract will be set in precious metals or crypto currency or CAD or US Dollar equivalent through the artists fee schedule.
